Mealstash Terms of Service

Please read these Terms of Service (“Terms”) carefully before using our website, www.Mealstash.com (the “Site”). These Terms govern your use of the Site, and are a legally enforceable contract between Mealstash (“Mealstash” or “we”) and you. By accessing or using the Site, the Mealstash service, or any applications (including mobile applications) made available by Mealstash (together, the "Service"), however accessed, you agree to be bound by these Terms.

We may make changes to these Terms at any time by posting them to the Site. Any changes will be effective at the time of posting.

Basic Terms

You must be at least 13 years old to use the Service.
You may not post obscene, vulgar, unlawful, infringing, hateful, offensive, pornographic or sexually suggestive photos or other content via the Service.
You must abide by all applicable laws and refrain from violating any third party rights.
You agree to keep your login information and password secret and secure.
You may not use the Service for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws.
You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, recipes, directions, notes, links and other content or materials (collectively, "Content") that you submit, post or display on or via the Service.
You must not use domain names or web URLs in your username without prior written consent from Mealstash.
You agree that you are responsible for all data charges you incur through use of the Service.
You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature. You may not inject content or code or otherwise alter or interfere with the way any Mealstash page is rendered or displayed in a user's browser or device.
Violation of these Terms of Use may, in Mealstash's sole discretion, result in termination of your Mealstash account. You understand and agree that Mealstash cannot and will not be responsible for the Content posted on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Mealstash, we can stop providing all or part of the Service to you.

Account Registration

In order to access or use certain Services, you will need to create an account ("Account"). You will not create an Account for anyone other than yourself and you are responsible for any activity that occurs through your Account. You also represent that all information you provide or have provided to Mealstash when you create your Account and at all other times must be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy.

We reserve the right to force forfeiture of any username, or to modify or terminate the Service or your access to the Service for any reason, without notice, at any time, and without liability to you.

Recipes and Content

Mealstash does not claim ownership of any Content that you post on or through the Service.

Instead, you hereby grant to Mealstash a worldwide non-exclusive, fully paid and royalty-free, transferable, irrevocable, and fully sub-licensable right to use, store, reproduce, modify, adapt, create derivative works, distribute, license, sell, transfer, and publicly display such Content throughout the world in any media. You agree that this license includes the right for other users of the Service to access, view, modify, edit, download and print any Content, such as recipes and images, for their own personal and non-commercial purposes.

You represent and warrant that: (i) you own or otherwise control all rights to any Content you submit, post or display on or through the Service; (ii) you are responsible for your use of the Service, for any Content you provide, and for any consequences thereof, including the use of your Content by other users; (iii) the Content you supply does not violate, misappropriate or infringe on the rights of any third party, including, without limitation, privacy rights, publicity rights, copyrights, trademark and/or other intellectual property rights; and (iv) you have the legal right and capacity to enter into these Terms of Use in your jurisdiction.

Mealstash takes no responsibility and assumes no liability for any content posted by you or any third party. We have the right, but have no obligation to monitor, remove, edit, and/or block Content or accounts containing Content that we determine in our sole discretion violates these Terms of Use.

We respect other people's rights, and expect you to do the same.

We provide you with tools to help you protect your intellectual property rights. To report a claim of intellectual property infringement, please contact us via email.

If you repeatedly infringe other people's intellectual property rights, we will disable your account when appropriate.

Indemnity

You agree to defend, indemnify, and hold Mealstash and its associates harmless from and against any claims, liabilities, damages, losses, and expenses (including, without limitation, interest, penalties, attorney fees, accounting fees, and expert witness fees) arising out of or in any way connected with your access to or use of the Services or your violation of these Terms. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claim.

Disclaimer of Warranties and Limitation of Liability

THIS SITE IS PROVIDED BY MEALSTASH ON AN "AS IS" AND "AS AVAILABLE" BASIS. YOU ACKNOWLEDGE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MEALSTASH DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, PERFORMANCE, QUIET ENJOYMENT, SYSTEM INTEGRATION, FREEDOM FROM COMPUTER VIRUS, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Mealstash makes no warranty that the Service will be error-free, uninterrupted, secure, or meet your requirements; that defects will be corrected; or that the Service, its servers, or e-mail sent from Mealstash are free of viruses or other harmful components.

Mealstash makes no representations or warranties that the information or Content on the service is accurate, timely, complete, or useful. The Content, including the recipes and all related information made available through the Services is for informational purposes only and is not intended to be (and does not constitute) dietary advice or recommendations specifically for you.

The Service contains links to third-party websites that are not owned or controlled by Mealstash. We do not endorse or assume any responsibility for any such third parties or third-party properties. If you access a third party website, app or other property, you do so at your own risk and you agree that Mealstash will have no liability arising from your use of any such properties.
